January

Walt Disney World isn't just about thrill rides and Mickey Mouse, fitness is also important. The first weekend in January is host to the Walt Disney World Marathon Weekend in which celebrity runners lead participants in a short marathon designed to promote an active lifestyle. The Sports Complex at Walt Disney World offers participants seminars in training, racing and nutrition.

February

Mardi Gras starts early in Orlando, specifically at Universal Studios. Experience the Orlando style of Mardi Gras with music, Cajun food and of course lots of entertainment for the whole family. The celebration runs well into April, so there is lots of time to schedule! SeaWorld has its annual Bands, Brew and BBQ for three weeks during February and March. There is lots of great BBQ'd food, world famous bands and locally brewed beer. Disney is also holding its President's Day Soccer Festival in which families of all ages can come and watch or participate in soccer competition.

March

From the beginning of March all the way into May, Epcot Center hosts the International Flower and Garden Festival. The festival showcases extraordinary garden displays, all in international themes. March is also the time to see the Global Pet Event Expo in Orlando. See all the wild and exotic creatures people from all over the US call their pets. Learn how to care for those rare animals, or maybe bring home a new furry friend! Plus, what is March in Orlando without a St. Patrick's Day celebration? The seventeenth of the month is marked with the St. Patrick's Day Party at Downtown Disney starting at eleven in the morning! All ages are welcome. The first week of March is marked by Bike Week in Daytona Beach, which brings bikers from all over the US. This is the east coast version of Sturgis!

April

What's the best part of April? Easter of course! Celebrate Easter at Disney World with live performances with the Disney characters in Disney's Magical Kingdom Park. Plus, don't forget the Marshmallow Drop in Barnett Park where children are welcome to fill their Easter baskets with hidden marshmallows! One of April's biggest events is the Fiesta Medina, the largest Latin American heritage celebration in the state! There is food, music and entertainment for the whole family. In conjunction with Fiesta Medina is Fiesta in the Park, held at Lake Eola in downtown Orlando. Each April holds the worldwide Earth Day and SeaWorld embraces that day. Don't miss Jack Hanna's Weekends at SeaWorld during April for an Earth Day celebration. Some of Jack Hanna's favorite friends from all over the world will be in attendance.

The King Cobra (Ophiophagus hannah) is also remarkable in this large family of snakes (elapidae) because it feeds almost entirely on other snakes with mice and small birds also falling prey to its poison.

The King Cobra is also unique because of its size - it can reach 5.85m (almost 20 feet) in length, which makes it the longest poisonous snake in the world. The latest discovery of a new species of cobra was made in 2003 when it was identified by London Zoo as part of an illegal shipment of exotic pets.

DNA studies revealed that this new species of snake is similar to the red spitting cobra but has different genes. It seems to originate from an area between Sudan and Egypt and it has been called the 'Nubian Spitting Cobra'.

Though highly dangerous when it senses a threat, a cobra will not attack if you leave it in peace, although the venomous spit can travel very accurately for two meters. If compared to the strike of a rattlesnake, the cobra is pretty slow in attack, and many bites prove blank, that is without envenomation.

According to a study conducted on Malaysian cobra snake victims only 55% of the bites involved venom release and the same statistics indicate a mortality rate of 10% for people bitten, since the toxins injected into the blood of the prey destroy the nerves (neurotoxin) , which induces respiratory failure half an hour after being bitten, giving you 30 minutes to get help.

Their colouration varies from light green-grey to black, although juveniles are yellow and black banded.This snake is widespread throughout south-eastern Asia.

Replevin is a legal procedure to obtain recovery of property, and under Florida law there are two types of replevin. One type is the ordinary replevin action, providing for recovery of personal property after trial on the merits and entry of final judgment. The other type is the prejudgment writ of replevin, which is a summary procedure allowing ex parte recovery of the property. Its purpose is to protect the petitioner against various risks, such as destruction or concealment of the subject property or removal from the jurisdiction of the court. This article briefly discusses the prejudgment writ of replevin.

Under section 78.068, Florida Statutes, a prejudgment writ of replevin may be issued and the property seized when the nature, amount, and grounds of the claim "clearly appear" from specific facts in a sworn statement by the "petitioner," i.e., the party who wants to get possession of the property. The court must also find, based on the petition, that the defendant is "engaging in, or about to engage in, conduct that may place the claimed property in danger of destruction, concealment, waste, removal from the state, removal from the jurisdiction of the court, or transfer to an innocent purchaser during the pendency of the action or that the defendant has failed to make payment as agreed."

The petitioner must post a bond in the amount of twice the value of the goods subject to the writ or twice the balance due and owing, whichever is less as determined by the Judge. The purpose of the bond is to serve as security for the payment of damages the defendant may sustain when the writ is wrongfully obtained. The defendant, however, has two main statutory protections.

One way that the defendant can obtain release of the property is by posting a bond within 5 days after being served with the writ. The amount of the bond must be 1 the amount due and owing on the agreement for the satisfaction of any judgment which may be rendered against the defendant. Alternatively, a second way to obtain release of the property is by filing a motion to dissolve the prejudgment writ of replevin. The defendant must file the motion within 10 days after service of the writ and the Judge is required to set the motion for an immediate evidentiary hearing. The burden of proof is on the petitioner, not the defendant, to prove the grounds upon which the writ was issued by "competent and substantial evidence." See, for example, Kalman v. World Omni Financial Corporation, 651 So.2d 1249, 1252 (Fla. 4th DCA 1995) (appellate court dissolved writ of replevin allowing seizure of automobile where petitioner did not meet its burden at the hearing on defendant's motion to dissolve writ).

By way of example, defendants can successfully challenge prejudgment writs of replevin where the sworn statement the petitioner submitted is merely based on "information and belief," instead of the required first-hand personal knowledge, where the underlying contractual documents do not clearly demonstrate the petitioner's entitlement to the property, where the subject property cannot be clearly identified to establish the possessory interest, or where the petitioner has waived its right to timely payment if the writ was issued based on failure to make payment as agreed. A careful petitioner or defendant should consider and anticipate such challenges.
